S.D. Codified Laws § 22-23-1 (Prostitution — Penalty.)
A person who is eighteen years of age or older and who engages in or offers to engage in sexual activity for a fee or other compensation is guilty of prostitution, a Class 1 misdemeanor.
Amendment History: The 2017 amendment by ch. 97 added “aged sixteen years or older” in the first sentence.
The 2019 amendment by ch. 109 rewrote the former first and second sentences as the first sentence.
