Synopsis/ Summary:

This Act brings Delaware into compliance with the federal No Human Trafficking on Our Roads Act by creating a lifetime disqualification for a commercial diver license if the individual engages in human trafficking while using a motor vehicle. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.

SENATE BILL NO. 223

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO DISQUALIFICATION FROM DRIVING A COMMERCIAL MOTOR VEHICLE.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 2603, Title 21 of the Delaware Code by making deletions as shown

by strike through and insertions as shown by underline as follows:

§ 2603. Definitions.

Notwithstanding any other provision of this title, the following definitions apply to

this chapter:

( ) “Human traficking” means as “human traficking” is defined in § 787 of Title 11. Section 2. Amend § 2612, Title 21 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 2612. Disqualification and cancellation.

(d) A person is disqualified from driving a commercial motor vehicle for life who uses a motor vehicle in as follows:

(1) In the commission of any felony involving the manufacture, distribution, or dispensing of a controlled substance or possession with intent to manufacture, distribute distribute, or dispense a controlled substance.

(2) In the commission of a felony involving human traficking.
